Q: I made a purchase through your website. How do I get my item(s)?
A: In-person pickups are scheduled via email after purchase. Local delivery is available within the DMV Metro Area (up to 15 miles outside the Beltway). Delivery is free for orders over $200. For more details or to arrange pickup/delivery, please message us at pastpresentmarketplace@gmail.com.  

Q: Is shipping available if I don’t live in the DC Metro Area?
A: Some vendors offer shipping on smaller items — listings will note when shipping is available. We also work with third-party services like U-Ship for larger deliveries. Please reach out if you'd like help coordinating shipping.

Q: What is your return policy?
A: All sales are final. Because most of our inventory consists of previously owned, vintage, or consigned items, we are unable to offer returns or exchanges.

Q: Are you currently accepting new vendors?

Past & Present Marketplace Buyer Agreement

Before you may register as a buyer to shop on our site www.pastandpresentmarketplace.com (the "Site"), you must read and accept all of the sections below, as amended from time to time (collectively, the "Agreement"). This Agreement is immediately effective for current Buyers and upon acceptance by new Buyers. As used herein, "Seller" shall mean any party who opens a shop on the Site, and "Buyer" shall mean any party who registers with the Site to shop online.

1. Our Authority

We have the sole authority and discretion to operate and maintain the Site. Accordingly, we reserve the right to remove any item, picture, or posting from our Site at any time for any reason, without notice to any Buyer. We are under no obligation to remove or change any item, picture, or posting from our Site at any Buyer’s request, and any such requests shall be resolved at our sole discretion.

In transacting with Sellers, Buyers are solely responsible for exercising the principle of "buyer beware" as they would in any real marketplace. We are not responsible for addressing or assisting with disputes between or complaints about any Buyers or between Buyers and Sellers. In the event of a concern, claim, or dispute, Buyers shall communicate directly with the other party to resolve it. We may investigate complaints at our discretion and direct the Buyer to respond to the other party directly.

We reserve the right to refuse service to anyone, reject any Buyer registration, and discontinue existing service at any time. We also reserve the right to assist Sellers in blocking any Buyer from purchasing items from a Seller's shop, or cancel a Buyer’s membership and access to our Site due to unprofessional conduct, complaints, or other behavior disruptive to the Site or its reputation.

2. Buyer Representations and Covenants

By using our services, you represent to us that:

  • (a) You are not a minor under applicable law and have the authority to enter into legal contracts;
  • (b) The information you provide during registration and afterward is, to your knowledge, complete, truthful, and accurate.

By accessing and using the Site, you agree that you will:

  • Conduct all transactions with Sellers in good faith;
  • Refrain from placing orders with no intention of purchase;
  • Abide by payment terms and any Seller-specific terms of sale;
  • Pay all amounts owed to Sellers promptly;
  • Pay all applicable sales taxes from transactions conducted on the Site.

You agree that you will not:

  • Interfere with a Seller’s business or post false, misleading, defamatory, or libelous content about any Seller, Buyer, or Past & Present Marketplace;
  • Complete transactions outside of the Site in an attempt to avoid taxes or fees;
  • Copy, use, modify, or distribute Site content, including photos, without permission;
  • Engage in spamming, hacking, harvesting user data, or using technology that harms the Site;
  • Act in an unprofessional or offensive manner when using the Site or communicating with Buyers, Sellers, or Site personnel;
  • Violate any law, third-party rights, or posted Site policies.

We may terminate this Agreement or your access to the Site immediately and without notice for breach of any of the above.

3. Release of Claims

Past & Present Marketplace is a venue for Sellers to conduct sales and for Buyers to purchase Sellers’ items. We are not involved in the actual transaction between Buyers and Sellers. In the event of a dispute between parties, you release Past & Present Marketplace (and its owners, officers, agents, and employees) from any and all claims or damages, actual or consequential, arising from such disputes.

If you are a California resident, you waive California Civil Code §1542, which states:

"A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

4. Intellectual Property Rights

This Agreement does not grant you any rights to our trademarks, branding, logo, or proprietary content developed by or for the Site. These remain the sole property of Past & Present Marketplace.

5. Content License

If you provide us with content (e.g., reviews, messages), you grant Past & Present Marketplace a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to use, copy, and display that content in any media now known or later developed.

6. Termination

This Agreement may be terminated at any time by either party. If you terminate the Agreement, you agree to cease use of the Site as a Buyer.

7. Limitation of Liability

You agree that Past & Present Marketplace is not responsible for the actions or inactions of Sellers or Buyers. We do not guarantee the authenticity, safety, legality, or value of any items listed by Sellers or that transactions will be successfully completed.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we will not be liable for personal injury or any incidental, indirect, special, or consequential damages, including loss of profits, data, or business interruption. If any liability is found, our total liability shall not exceed the purchase price of the item(s) in question.

8. Disclaimer of Warranties

YOU AGREE THAT YOUR USE OF THE SITE IS AT YOUR OWN RISK. THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Site will operate without interruption or error, or that all content is accurate or complete. No oral or written information from Past & Present Marketplace shall create any warranty not explicitly stated herein.

9. Indemnification

You agree to indemnify and hold Past & Present Marketplace (including its officers, employees, and agents) harmless from any claims or demands (including legal fees) arising out of your breach of this Agreement or violation of any law or third-party rights.

10. No Agency

This Agreement does not create a partnership, agency, joint venture, or employment relationship between you and Past & Present Marketplace.

11. Governing Law and Severability

This Agreement shall be governed by the laws of the State of California, without regard to its conflict of laws provisions. If any part of this Agreement is held invalid, the remaining provisions shall remain in full effect.

12. Venue

Any claim or dispute under this Agreement shall be brought in a court located in San Francisco County, California, unless otherwise agreed by the parties. You agree to submit to that jurisdiction.

13. Notices

Notices to Past & Present Marketplace should be sent via email or U.S. mail to:

Notices from us to you will be sent to the email or physical address you provided during registration.

14. Entire Agreement

This Agreement, along with any Site policies, constitutes the full agreement between you and Past & Present Marketplace. It supersedes all prior agreements or understandings.

15. Additional Policies

You agree to comply with any additional policies posted on the Site (e.g., Help pages, FAQs). These may be updated periodically without direct notice.

16. Amendments

We may amend this Agreement at any time. You will be asked to accept new terms upon next login after amendments are made. Continued use of the Site constitutes acceptance of the revised Agreement.

17. Arbitration

Any dispute arising under or relating to this Agreement shall be resolved through binding arbitration in San Francisco, California under the administration of JAMS. Judgment may be entered on the award in any court with jurisdiction. Either party may seek provisional relief from a court before arbitration begins.

18. Survival

The following sections will survive termination: Sections 2 through 20.

19. Headings

Headings are for convenience only and do not affect interpretation.

20. Waiver

Failure to enforce any part of this Agreement does not waive the right to enforce it in the future.
